Do I Really Need a Lawyer After a DUI Arrest?

Anderson Barkley, LLC Nov. 7, 2026

You’ve been arrested for DUI, and now you’re wondering whether hiring a lawyer is necessary or just another expense. Colorado law doesn’t require you to hire a lawyer, but legal representation can help you address criminal charges, protect your rights, and respond to proceedings that could affect your driving privileges.

Anderson Barkley, LLC, provides criminal defense representation in Denver, Colorado, helping you examine the evidence against you and consider your legal options. The firm can help you identify important deadlines, including the seven-day window to request a DMV hearing, and make informed decisions about your defense.

DUI Charges and License Revocation

A Colorado DUI arrest can trigger two separate proceedings: a criminal case handled by the courts and an administrative process involving the Colorado Division of Motor Vehicles (DMV). A lawyer can help you address both, but neither proceeding requires you to hire private counsel.

The criminal case determines whether you’re guilty of driving under the influence and what penalties may follow. Depending on the charge and your history, a conviction can result in jail time, fines, probation, treatment requirements, and other consequences.

The DMV proceeding determines whether your driving privileges should be revoked based on chemical test results or refusal to submit to testing. These proceedings operate independently, meaning your license could be revoked even if the criminal charges are dismissed.

The Seven-Day DMV Deadline

Under Colorado’s expressed consent procedures, you generally have seven calendar days to request a DMV hearing. However, when that period begins depends on the type of chemical test involved:

  • Breath tests or alleged refusals: The deadline typically starts on the date of arrest.

  • Blood tests: The deadline generally starts on the date of the DMV’s mailed notice.

The Colorado DMV’s administrative hearing guidance explains these deadlines and how to request a hearing through the myDMV system. You can request a hearing without a lawyer, but missing the deadline generally means giving up your opportunity to contest the administrative revocation.

Refusing a legally requested chemical test can also have serious consequences. A first refusal generally results in a one-year license revocation and a Persistent Drunk Driver designation, which carries additional reinstatement requirements.

Eligible Colorado residents who were at least 21 at the time of the violation may seek early reinstatement with an ignition interlock device. For qualifying per se revocations involving violations on or after January 1, 2023, you can apply when the revocation takes effect. Chemical test refusals generally require serving two months first. Early reinstatement and contesting the revocation are separate options, and eligibility and reinstatement requirements still apply.

A lawyer can review the evidence supporting the revocation, represent you at the DMV hearing, and help you understand how the administrative proceedings relate to your criminal case. If you’re considering hiring counsel, preserve your citation, testing paperwork, DMV notices, and any information that may help establish what happened during the arrest.

The Role of a DUI Defense Lawyer

A DUI defense lawyer reviews the prosecution’s evidence, identifies possible defenses, negotiates plea agreements, and represents you in court. Through criminal defense representation, a lawyer can examine:

  • Traffic stop and arrest: Whether police had legal grounds to stop and arrest you.

  • Chemical testing: Whether blood or breath tests were properly administered and produced reliable results.

  • Field sobriety exercises: Whether testing procedures or conditions affected your performance.

  • Police and witness evidence: Whether reports, recordings, or statements contain inconsistencies that support your defense.

Colorado recognizes DUI, driving while ability impaired (DWAI), and DUI per se. DUI per se generally involves a blood alcohol concentration (BAC) of 0.08% or higher at the time of driving or within two hours afterward. A BAC above 0.05% but below 0.08% permits an inference of DWAI, while impairment-based charges may apply even at lower BAC levels.

Legal representation may be particularly important if your case involves prior convictions, injuries, chemical test refusal, or a high BAC. A fourth or subsequent qualifying DUI-related offense can be charged as a class 4 felony following three qualifying prior convictions from separate criminal episodes.

A lawyer can also evaluate plea offers and explain how accepting one may affect your criminal case without necessarily resolving separate DMV consequences. Although representation cannot guarantee a particular outcome, it allows you to challenge the evidence and make informed decisions about your defense.

Private Lawyer, Public Defender, or Self-Representation

After a Colorado DUI arrest, you generally have three options for handling your criminal case. Each comes with different costs, responsibilities, and levels of legal assistance.

Hiring a Private DUI Defense Lawyer

A private lawyer allows you to choose your attorney and obtain representation for both your criminal case and separate DMV hearing. However, legal fees may be a consideration, especially for a first offense.

Seeking a Public Defender

If you cannot afford private counsel, you may qualify for a public defender based on your financial circumstances and applicable eligibility requirements. The Colorado Judicial Branch explains how to apply.

Public defenders represent eligible defendants in criminal proceedings, but their appointment does not cover separate administrative DMV hearings.

Representing Yourself

Colorado permits you to represent yourself, but you must handle court procedures, review evidence, present legal arguments, and evaluate plea offers. You may also represent yourself at the DMV hearing.

Before deciding, consider the seriousness of your charges, the evidence against you, and the potential consequences. A legal consultation can help you understand your options.
